JD Capital ("the firm," "we," "us") is a private commercial real estate investment firm based in Calgary, Alberta. This policy explains what personal information we collect through jdcapital.net, why we collect it, who it is shared with, how long we keep it, and how you can access or delete it. It is written to meet our obligations under Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and Alberta's Personal Information Protection Act (PIPA).
What we collect
Information you provide. When you submit one of our forms, we collect what you enter. Depending on the form, that may include your name, email address, telephone number, company or business name, the structure or investment range you indicate an interest in, your confirmation of accredited investor status, and any message you write.
Information collected automatically. When a form is submitted, our server also records your IP address, the country associated with it, your browser's user agent string, and the page you submitted from. We collect these solely to detect and filter automated and fraudulent submissions. We do not use them to build a profile of you, and we do not use advertising or tracking cookies on this site.
Why we collect it
- To respond to your inquiry and, where relevant, continue a conversation with you
- To send you a document you have requested
- To assess whether a prospective investor meets the eligibility requirements that apply to private securities offerings
- To protect the site against automated abuse
- To meet record-keeping obligations that apply to us
We do not use your information for any purpose unrelated to the above without asking you first.
Who your information is shared with
We do not sell your personal information, and we do not share it with third parties for their own marketing purposes.
We do use service providers to operate the site, and your information passes through them:
- Cloudflare, Inc. — hosts this website and stores form submissions. Cloudflare operates a globally distributed network, so data may be processed outside Canada.
- Web3Forms — delivers form submissions to our inbox by email. This service is operated outside Canada, including in the United States.
- Google LLC — provides our business email, through which we read and respond to inquiries.
Cross-border transfer. Because these providers operate outside Canada, your personal information may be stored or processed in other countries and may be accessible to the courts and law enforcement of those countries under their laws. We use these providers under contract and limit what we send them to what is needed to operate the site.
We may also disclose information where required by law, or to professional advisers such as legal counsel, in confidence.
How long we keep it
Inquiry records are retained for 24 months from our last contact with you, after which they are deleted. Submissions identified as automated or fraudulent are stored separately and deleted automatically within 14 days.
Where we enter into an investment relationship with you, records associated with that relationship are kept for longer, as required by securities, tax, and anti-money-laundering rules.
How it is protected
Submissions are transmitted over encrypted connections (TLS) and stored in access-controlled infrastructure. Access is limited to the people who need it to respond to you. We do not publish a general contact email address; the forms on this site are the only intake channel, which reduces exposure to interception and harvesting.
No system is perfectly secure. If a breach occurs that creates a real risk of significant harm to you, we will report it to the Office of the Privacy Commissioner of Canada and notify you, as PIPEDA requires.
Your rights
You may ask us to:
- Access the personal information we hold about you
- Correct it if it is inaccurate or incomplete
- Delete it, where we are not required to retain it
- Withdraw consent to further contact, at any time
Submit any of these requests through the inquiry form, marking your message "Privacy request." We will respond within 30 days. There is no charge.
If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada, or the Office of the Information and Privacy Commissioner of Alberta.
Marketing email
Where we send commercial electronic messages, we do so in accordance with Canada's Anti-Spam Legislation (CASL). Every such message identifies the firm, provides a mailing address, and includes a working unsubscribe mechanism. Unsubscribe requests are honoured promptly and permanently.
Children
This site is directed to adults evaluating private investment opportunities. We do not knowingly collect personal information from anyone under the age of 18.
Changes to this policy
We may update this policy as our practices or obligations change. The date at the top reflects the current version.
